Scope of application

These general conditions (hereinafter the “General Conditions”) are applicable to all promotions, offers and sales of articles made through Wivai and their purpose is to explicitly establish the contracting processes completed by users (hereinafter the “Customer”) for products and/or services offered by Wivai through its website www.wivai.com, or through the Wivai section of the CaixaBank website (hereinafter the “Website”). The specific conditions (such as the price, features, payment, delivery, etc.) that are indicated for each product on the product information page with the offer and during the purchasing process itself will also be applicable.

These General Conditions will remain in force and will be valid for as long as they are accessible via the Website, without prejudice to the fact that Wivai reserves the right to amend, without prior notice, both the General Conditions and any other legal texts that are displayed on the Website. Without exception, access by users to the Website after their amendment, addition and/or replacement represents their acceptance.

The Customer is subject to the General Conditions in force at any time when contracting a product and/or service, and it is not possible to contract any product and/or service without the prior acceptance of these General Conditions. The General Conditions will be valid for as long as they are on display, until they are fully or partially amended. The new General Conditions will be applicable from the moment when they are provided to the Customer and are therefore fully available.

All the purchases of products or services bought through the Website may be made as a “guest”, with no need for the user to be a registered user or have prior identification and authentication through a provided username and passwords. In both instances, purchases made will be considered validly performed by the Customer and will be binding. Consequently, the Customer will be exclusively responsible for any purchases of products or services through the Website made by any third party that uses their username and password. The placing of orders through the Website by a minor who gives false registration information will be understood as carried out under the supervision and authorisation of their parents, guardian or legal representatives.

Only non-commercial Customers are authorised to make purchases through the Website. The purchase of products on the Website for their resale, assignment and/or wholesale sale is strictly forbidden . If, in certain circumstances (such as the number of units purchased, the type of product, details of the offer or any other reason) Wivai has evidence that said prohibition is being violated, it will carry out the relevant checks - including contacting the Customer - and may cancel any purchases that it suspects have been made for illicit purposes. Suspected fraudulent orders may be reported to the relevant authorities so that they can take the relevant legal action.

Contracting procedure. Partner companies for promotions and special offers

In general, the online contracting process through the Website will be between the “Customer” and “Wivai”.

Promotions and the marketing of offers of third-party companies on the Website (hereinafter Partner Companies) are carried out by Wivai, although in some cases, which will be expressly specified in the purchasing process for each product, the contracting of the product or service is between the Customer and said Partner Company. In such cases, Wivai’s involvement is limited to marketing and offering the product or service in question to the Customer on behalf of the Partner Company.

CaixaBank, S.A., with registered office at calle Pintor Sorolla, 2-4, 46002 Valencia, with company tax number (NIF) A08663619, registered in the Special Administrative Register of the Bank of Spain with registration number 2100 and in the Companies Register of Valencia, in volume 10370, folio 1, page V-178351, and CaixaBank Payments & Consumer, E.F.C. E.P., S.A.U., with registered office at la Avenida de Manoteras nº 20. Edificio París. 28050 Madrid, with company tax number (NIF) A-08980153, registered in the Companies Register of Madrid, page M-656492, and registered in the Special Administrative Register of the Bank of Spain with registration number 8776, collaborate exclusively on financing for the purchase of goods or the contracting of services from Wivai.

These offers are subject to the rules and regulations established by the 7/1996 Retail Trade Regulation Act, the 34/2002 Information Society Services and Electronic Commerce Act (hereinafter the “ISSA”), Legislative Royal Decree 1/2007 of 16th November, which approves the consolidated text of the Consumer Protection Act, the 7/1998 General Contracting Conditions Act, Royal Decree 1906/1999, which regulates General Telephone and Online Contracting Conditions in implementation of article 5.4 of the 7/1998 Act, Royal Decree-Law 14/1999 regulating Electronic Signatures and all other applicable legal provisions.

Access to and registration on the Website

Access to and the browsing of the catalogue of products and services published on the Website are freely available and free of charge, with no need for users to register.

Similarly, in order to initiate the contracting process for the products and/or services displayed on the Website, users may log in using their registered username or continue the purchase as a guest.

Requirements to register as a user.
In order to register, users must be over eighteen (18) years of age and provide all the necessary information that is identified as required using the form provided by Wivai on the Website. Registered users accept that their user account is personal and non-transferable, and both natural and legal persons may register on the Website.

All registered users will have a login password, which will always be personal, non-transferable, have a limited validity period and must fulfil some requirements in terms of length and security. Users may change or recover said password at any time, by following the procedure provided on the Website. Under no circumstances will Wivai know said password, which will remain encrypted in Wivai’s systems.

EBy virtue of the above, it is the user’s obligation to immediately inform Wivai of any circumstance that might permit the improper use of the usernames and/or passwords, such as their theft, loss or unauthorised access using them, so that Wivai can immediately cancel them. Until such circumstances are reported, the provider is exempt from any liability that might arise from the improper use of the usernames or passwords by unauthorised third parties.

Cancellation as a registered user.
The legal relationship arising from the registration of the Customer on the Website has an indefinite term. Either of the parties may terminate or suspend this contractual relationship at any time based purely on their wish to do so, without prejudice to the obligations arising from the placing of orders before the termination of the relationship. The Customer may unilaterally exercise their right to termination by using the account cancellation process.

Charges, stocks and advertising

The prices of all the products promoted by Wivai include taxes and delivery costs, unless expressly indicated otherwise in the purchase process. Certain products, such as vehicles, involve other expenses that are not included, such as registration expenses and relevant taxes, which are not included in the indicated price and will be at the expense of the Customer.

All the promotional offers that are shown on the Website are valid for as long as they appear on the Website and specific information will be given about the terms and conditions of each promotion. In all instances, the completion of an order on the Website will be subject to product availability. In the case of products that are given away in promotions, the specific terms and conditions provided in each promotion will be applicable, such as the duration of the promotion, the number of units available, eligibility requirements, etc.

The contents, product catalogue, special offers, promotions, images and, in general, all information published by Wivai, whether on the Website or on other media, will be considered valid until the indicated date or, in all instances, until they are updated. Wivai reserves the right to update, amend or delete contents without notice as it deems appropriate. Said amendments and updates will be published and will be available to the Customer at all times on the Website. When the Customer has received confirmation of their order from Wivai, the sales conditions of the order may no longer be changed.

Wivai carries out all due diligence to ensure that the contents are presented realistically. However, the prices, features and images may contain typographical errors. Wivai is not compelled to provide a product if the mistake is obvious and unambiguous and could have been recognised by the Customer.

Seller warranty

The products that can be purchased will comply with the published features and the manufacturer’s description, without any faults that could stop their normal use according to their intended purpose and must provide the features described for the product.
If this is not the case, and is not due to causes attributable to the Customer, the Customer will have the right to the repair or replacement of the purchased product, for a period of 3 years from the date of purchase for products purchased after 1st January 2022 and 2 years for products purchased before 1st January 2022, under the conditions and with the evidence established in the consolidated text of the Consumer Protection Act, all without prejudice to the rights that Wivai (and in turn the manufacturer of the product) has to check the veracity of the faults, their origin and the time of their appearance (hereinafter the “Legal Warranty"). If the non-conformity appears during the first years after the delivery of the article, it is assumed that it existed when the product was delivered.

Each product available for purchase is sent to the purchaser with the relevant instructions for use and the manufacturer’s general conditions. In addition to the Legal Warranty, the manufacture my voluntarily give an additional commercial warranty, in which case this will be sent with the purchased product indicating its terms and conditions.

The Customer must keep their receipt or proof of purchase as warranty against any possible future product changes, repairs or returns.

In the case of second-hand or reconditioned items, so described in the product information file in the purchase process itself, like second-hand vehicles, the warranty period is fixed at 1 year.

To report a fault or non-conformity, the Customer can contact the technical support helpline of the manufacturer of the product directly or contact Wivai directly, if Wivai is the vendor. In cases of where products are just marketed by Wivai, requests related to faults or non-conformities may not be resolved by Wivai. The Customer must make the request to the vendor. The identity of the vendor is specified in the purchase process of each product as applicable.

Home delivery

The home delivery service is restricted to Spain. The free home delivery service (when offered) is a gift from Wivai, thanks to the agreements reached with the manufacturers and distributors of the various marketed brands. There is no additional cost for the Customer.
The order will be delivered by a courier service to the address indicated by the Customer, as included in the specific purchase conditions (order summary), within a period of 5 working days after payment, except for cases of force majeure (in the case of deliveries to the Canary Islands, there is an additional period of up to 7 working days). In the vast majority of cases, the delivery time is shorter, but it will depend on the delivery address and the routes of the logistics services.

If the order is to be delivered to a company’s address, the carrier company will leave the delivery at reception or delivery point and will request a signature from the receptionist or concierge, without the signature of the person to whom the parcel is addressed being required for it to be understood as duly delivered.

If the indicated address is a personal address with a concierge, the carrier will deliver it directly to the concierge. The concierge can sign the acknowledgement of receipt provided that there is a concierge desk at reception or in the building and it will be understood as duly delivered with said signature.

If the indicated address is a personal address that does not have a concierge, the item will only be understood as duly delivered when it is delivered to the address provided by the Customer in the purchase process and that appears in the order confirmation, without the signature of the person to whom the parcel is addressed being required.

Products delivered to dealerships (motor vehicles) are not delivered to the Customer’s address and must be collected by the Customer from the agreed-upon dealership or the dealership provided for this purpose during the contracting process.

Exercising your right of withdrawal

The purchaser has the right to withdraw from the purchase, by cancelling the contract within a period of 14 calendar days from the date of receipt of the ordered article to the indicated address, or from the contract signature date in service contracts.

The product to be returned due to the withdrawal must be in perfect condition, unused, with its complete original packaging, not registered (in the case of vehicles) and with all included accessories or free gifts.
In the case of large domestic appliances (washing machines, refrigerators, etc.), the product must be returned in the same condition as it was delivered and the return will not be accepted if it has been used (except for the tests carried out by the installer).

The vendor, after having confirmed the correct condition of the product, will refund its price within 14 calendar days from the date on which it received the notification of withdrawal from the order from the Customer.

To exercise their right of withdrawal the Customer must request it, either by completing a subform that can be found on the Wivai website in the “My Orders”> “Order cancellation or return” section, or by sending said request by email to Wivai, to: servicio.cliente@wivai.com

Wivai shall refund the relevant amount for the withdrawal from the purchase once it has received the returned product or when the Customer submits proof of the product’s return, whichever happens first. If Wivai offers to collect the product from the Customer’s address, the Customer must give a date and time for the collection. Wivai shall assume the expenses for the collection of the product.

When the Customer exercises their right of withdrawal and the price to be paid has been financed by CaixaBank, S.A or CaixaBank Payments & Consumer through the Website, exercising the right of withdrawal will involve the termination of the loan without any penalty whatsoever for the Customer.

Financial conditions and payment methods

All the products and/or services offered on the Wivai Website have the final price of the product displayed with it, along with, as applicable, any possible discounts on the purchase of said product or service.

The prices shown on the Website are solely applicable to the products offered through said channel and for as long as they remain published, and the same products may have different prices when purchased through the Wivai section available from CaixaBank, exclusively for its customers.

The product prices are always shown in euros and include VAT and any other taxes that are in force and legally applicable at the time.

If Wivai identifies a clear mistake in the price of one of the published products, it shall immediately notify the Customer and make the relevant rectifying publication on the Website and the usual media, and the Customer will have the option to reconfirm their order at the correct price or cancel it, through the “My Account” section.

Wivai expressly reserves the right to change the prices at any time with no need for prior notice. However, in all instances, the prices in force on the Website when the order in question is placed will be applied to the Customer.

Payment methods.

To make payment, the Customer must follow all the instructions shown in the online contracting process in the online purchase flow process.

All the payment methods provided by Wivai are subject to checks and authorisations by the companies that provide the payment methods (card issuers and/or payment account providers), but if said company does not authorise the payment, then the initiated purchase procedure may not continue and the order will be automatically cancelled and the sale of the requested product or products will be understood as not completed.

The charge of the product price and of any applicable taxes will only occur when the order is formalised. The following payment methods are available, depending on the product selected:

  • Immediate payment: by card, without financing. Payment option available for the entire catalogue of products.
  • Payment by finance: payment option available for products where financing is expressly offered through the following options:
    • Payment through a loan granted by CaixaBank, S.A.
    • Payment by a card from CaixaBank Payments & Consumer E.F.C., E.P., S.A.U. (hereinafter “CPC”) that accepts payment in instalments.

Finance through a loan with CaixaBank, S.A. or by a CPC card is offered for the purchase of products exclusively from Wivai and for the full indicated price for each product. Finance is subject to the analysis of the solvency and ability to repay of applicants, in accordance with the risk policies of the companies. If the Customer chooses the finance option and it is ultimately not granted, the order will be automatically cancelled.

Most products offer finance without interest charges or fees (APR 0% and NIR 0%) with various repayment periods, which the Customer must choose during the contracting process.

A representative example calculated to finance the total price of a product, €1,309 in this case: APR 0%, NIR 0%. Repayment period: 30 months. Total amount of the loan: €1,309. Amount of monthly instalments: 29 instalments of €43.63 and a final instalment of €43.73. Total cost of the loan: €0. French amortisation system. The price and the total instalment price would both be €1,309 in this case.

The products that offer finance with associated interest payments clearly indicate and specify in detail the financing conditions, which vary according to the chosen repayment period, on the product page and in the purchase process. The applicable financing conditions are also detailed in the order summary that the Customer receives with confirmation of their order.

It is also possible to pay for a purchase by redeeming a promotional code. Including a code in the payment process means using it to pay in full or in part, depending on the value of the code and the price of the product. Example: If the client has a promotional code for €200 and wants to buy a TV for €1,500, they will pay €200 using the promotional code and the remaining €1,300 by the form of payment of their choice: in cash or using finance.

Promotional codes can only be used for purchases made on the website. A promotional code cannot be sold, exchanged or given as a gift. A client with a promotional code must not publish or reveal this code on any website or in any other public form of gift, donation, sale or exchange. Promotional codes cannot be used for commercial purposes. The promotional code can only be used once per product and per order. It cannot be redeemed for money.

If through Wivai you contract products or services from third-party companies marketed by Wivai, some of your data, which we will notify you about, will be disclosed by Wivai to these third-party companies for the performance of the contract requested by you, and will be processed by said third-party companies as the data controller. What types of processing do we carry out using your data?

The processing of your data may vary depending on the degree of identification established in the contractual relationships that you have with us, and therefore:

If you have registered in Wivai using means of identification provided by CaixaBank, S.A. (“CaixaBank”), if you finance the purchase of a Wivai product through a credit transaction with CaixaBank or contract a renting product, we will consider you a fully identified customer (“Identified Wivai Customer”) and we will apply the following types of processing:

  • Processing based on your consent: This processing is only carried out if you have given your authorisation for us to do so.
    • o Prepare profiles and analyse your data so we can provide you with a personalised range of CaixaBank Group products and services.
    • Inform you about the range of CaixaBank Group commercial products and services.
    • Disclose your data to companies that do not form part of the CaixaBank Group.
  • Processing required for the performance of contractual relationships.
  • Processing required to comply with regulatory obligations.
  • Processing based on the legitimate interest of Wivai

If you register in Wivai without using the aforementioned means, as occurs in the user registration and the purchase of products and services on the Wivai website, we will consider you an unidentified user (“Wivai User Customer”), and we will apply certain types of processing, explained in this Privacy Policy.

Competent courts

The customer support service has a maximum period of one (1) month to resolve claims. In the event of disagreement with the resolution, or if the aforementioned period has passed without any resolution, the Customer may make a claim to the consumer authorities.

MyBox security and protection systems

Specific terms and conditions of the Senior Alarm and Protección Senior systems marketed by Wivai Selectplace, S.A.U. that will be provided by Securitas Direct S.A.U.

What service is offered?

One of the following:
MyBox Home Alarm, consisting of the installation and maintenance of a home security alarm system + 48 months’ support service by Securitas Direct, S.A.U.
MyBox Premium Home Alarm, consisting of the installation and maintenance of a home security alarm system + 48 months’ support service by Securitas Direct, S.A.U. Also includes an additional key safekeeping service.
MyBox Protección Senior is a personal protection service, inside and outside the home, through a central device and a wristwatch for monitoring. It includes 48 months’ support service by Securitas Direct S.A.U. This service is available as a Single type (with one monitoring watch) or DUO type (with two monitoring watches).

Who will provide the Service?

Securitas Direct S.A.U., with registered office at C/ Priégola nº 2 de Pozuelo de Alarcón (Madrid), and with company tax number (CIF) A-26106013.
Securitas Direct, S.A.U will install and maintain the security system (the alarm) and also sells the security system and any other items the customer might contract. Contracting the alarm and delivery of the other security items takes place later, between the customer and Securitas Direct, S.A.U. Wivai does not have access to the contract entered into between the customer and Securitas Direct, S.A.U.

Who markets the service?

Wivai Selectplace, S.A.U., with registered office at Gran Vía de les Corts Catalanes, 159, 08014 Barcelona. Company tax number (CIF) A-58481730. Wivai Selectplace, S.A.U. will also be the company that charges the monthly instalments for the service by direct debit: MyBox Single Debit. Under this system, CaixaBank S.A. will debit the customer for all payments due under the MyBox arrangement together.

Who will I pay for the service?

Wivai Selectplace, S.A.U. and Securitas Direct, S.A.U. have agreed to transfer all loans that Securitas Direct, S.A.U grants to customers that contract its service through Wivai Selectplace, S.A.U., S.A., and therefore although contracts are signed with Securitas Direct, S.A.U., and Securitas Direct, S.A.U., whichever provides the monthly service, you must pay the agreed monthly charges to Wivai Selectplace, S.A.U.

Securitas Direct, S.A.U. will officially inform you of the transfer of the loan to Wivai Selectplace, S.A.U. when you contract the service.
Wivai Selectplace, S.A.U. will collect the monthly charges by direct debit, but you should bear in mind that we will agree with you that you do not have the right to refuse to pay the direct debit provided that we present it at least 4 weeks before the date scheduled for payment of the debit.

Can I cancel the service whenever I want? If so, will I continue to pay the monthly charge?

By contracting the MyBox security and protection systems, you undertake to pay a monthly charge for the service that you will be provided with by Securitas Direct S.A.U., and therefore if at any time you wish to cancel the service you may do so and you will stop paying the monthly charge.

However, you must, as an obligation, maintain the contracted service for a minimum period of 36 months, in order to pay for the security equipment installed by Securitas Direct S.A.U. If you decide to cancel the service before the first 36 months have passed, you will be subject to a penalty for the cost of the installed security equipment and devices of up to €439 excluding taxes for alarm systems and Protección Senior systems.

This penalty will be reduced in proportion to the months of charges that you have paid to date, and unlike the monthly charges, it will be collected directly by Securitas Direct S.A.U.

Can I withdraw from the contract I sign with Securitas Direct S.A.U.?

Yes. You have 14 calendar days from the signing of the contract with Securitas Direct, S.A.U., without any need for justification, to withdraw from the contract. The conditions for exercising your right will be set out in your contract with Securitas Direct, S.A.U.


MyBox Protection Promotion February 2024: from FEB 5th to APR 26th, 2024.

What does this promotion consist of?

The promotion consists of the client receiving a pre-paid card issued by Global Payments MoneyToPay, EDE, S.L. with a balance of up to 750.00 euros if they fulfil these conditions:

What are the advantages?

The client will receive a pre-paid card, or a payment into their account if they are a legal entity, for the sum of:

  • 50.00 euros on acquiring a product listed in the "Products included in the promotion" section of this document, providing they have a contract dating from before the start of this promotion for any of the products qualifying for it, as listed in the "Products qualifying for this promotion" section of this document.
  • 75.00 euros per product, on acquiring two products listed in the "Products included in the promotion" section of this document.
  • 150.00 euros per product on acquiring three or more products listed in the "Products included in the promotion" section of this document.

The maximum amount that can be received per client will never exceed 750.00 euros.

And when is the pre-paid card or the payment into the account received?

These sums will be paid never less than two months after the end of the promotion, after checking that two or more products subject to the promotion have in fact been acquired, or installed if applicable, and the pertinent payments for them made.

If the card expires this will mean any remaining balance on it is lost and it will no longer work. The issue of payments and cards will end six months after the end date of the promotion.

Techbuddy

Specific terms and conditions of the TechBuddy technical support service marketed by Wivai.

What service is offered?

TechBuddy technical services will consist of the setting up and technical configuration of products that you purchase from Wivai. This service does not include the supply of cables or additional accessories required to operate or connect devices. Hereinafter the “Service”.

Wivai is responsible for the handling and/or technical configuration of devices, provided that this does not involve the use of external tools and/or the physical anchoring of devices.

Any additional service that you wish to contract and/or that is required for the correct provision of the contracted Service (such as the attachment or physical anchoring of devices or any kind of action that could affect the customer’s property - minor works -), will be subject to a separate quote and will not be carried out without the prior written acceptance of said separate quote.

Once you contract the Service, we will contact you within 48 hours to arrange a date and time slot for the technician’s visit. This date will depend on the delivery date of the device and will always be within 48 hours of delivery of the product. The times for the technician’s visit will be between 8.00 a.m. and 9.00 p.m., Monday to Friday.

Once the Service has been arranged, you will automatically be sent a provisional confirmation by email and text message (SMS) to keep you informed and notified about the status of your Service.

Once the Service is arranged, any changes that you need to make must first be sent by email to info@techbuddy.es.

Who will provide the Service?

TechBuddy Iberia, S.L., with registered office at Paseo de Gracia 50, 5º, 08007 Barcelona and with company tax code (NIF) B-67076406. This company is subcontracted by Wivai for the provision of the Service, but Wivai will be liable to you as the marketer of the Service.

Who markets the Service?

Wivai, which will also be the company that charges for the Service, as explained in the following point.

What is the price for the Service?

The price of the Service is €59, and this will be paid when customers contract the Service using the payment method they choose from those available on Wivai. The price includes Value Added Tax (VAT) and all other applicable taxes and will always be shown in euros (€).

Can I cancel the service whenever I want?

You can change the date/time of the appointment for the Service up to 12 hours before the agreed date and time for the Service, retaining the right to make a new appointment on another date if you prefer.

To cancel the Service, you must also return the product that was going to be installed/set up in accordance with the established deadlines and methods.

If the cancellation is made less than 12 hours before the agreed date and time for the Service, you will be given the option to rearrange the Service for a new date/time with an additional charge for the extra call-out by the technician (you will only be charged one (1) call-out charge for each attempt to provide the Services cancelled for this reason).

To change an appointment, you must send an email to info@techbuddy.es including your order number, telephone number and your full name. You may also contact us by telephone at 930 26 83 80.

If on the date scheduled for the provision of the Service in accordance with the contents of this document you are not available or if there is no one who can receive the technician in order for them to provide the Service, for a period longer than 30 minutes from the arranged start time, the Service will be cancelled and the technician will take a photograph of the main entrance and your door, including the date and time of the cancelled appointment. In this event, you will not be provided with the Service and, if you wish to be provided with it, you must pay the cost of a new service.

Wivai will not be liable for any delays that might occur in the provision of the Services that are a consequence of the cases indicated in the previous point, and you will receive the remaining service time of the total duration of the arranged service for cases with a delay of less than 30 minutes. If the delay is attributable to the technician, you will receive the full contracted service time.


Legal conditions for intermediation by Wivai in the purchase of Wallbox charging points sold and installed by Canarias Eléctrica de Energía Renovables y Movilidad, SL (EAVE) and marketed by Wivai.

 

ONE.- What is the product offered?

Through Wivai Selectplace, S.A.U (hereinafter “Wivai”), both through its own website www.wivai.com, and through the Wivai Store section of the Caixabank website (hereinafter referred to as the Portal), the client may apply to contract with EAVE a package consisting of the purchase of a Pulsar Plus type 2 car charger with a power rating of 7.4 kW or 22 kW, a Power Boost and a white cable holder, as well as the basic installation 20, 40 or 60 metres plus commissioning, where appropriate, of the products acquired.

TWO.- Who is the contract with? What does Wivai do?

Wivai, domiciled at Gran Vía de les Corts Catalanes, 159; 08014 Barcelona, with tax no. A-58481730 is the organisation that advertises the package and intermediates in the marketing of the said package. The client will enter into a contract with EAVE.

Wivai will handle the applications for contracts made by clients through the Portal and pass them on to EAVE for the latter to contact the applicants and, if appropriate, make the contract.

Canarias Eléctrica de Energía Renovables y Movilidad, SL (EAVE), domiciled at Calle Subida al Mayorazgo, 20; Santa Cruz de Tenerife (postcode: C.38110) and tax no. B76811348, will be the company that sells and installs the package. The contract for the package offered is to be made between the client and EAVE. Wivai has no access to the documents governing the contractual relationship between the client and EAVE.

THREE.- What does the client have to do before contracting the package?

To choose the appropriate product reference according to the length in metres and type of electrical installation, before entering into the contract for the package, the client must:

1. Confirm the type of electrical installation (single or three-phase) of the place where the products purchased are to be installed.

2. Confirm the distance between the electrical meter and the parking space

FOUR.- Installing the package, step by step

1. Request for information and welcome call

Within 24 working hours of the package being contracted, EAVE will contact the client to verify their details and arrange a video call.

If the client prefers, they can send a video to EAVE according to the instructions given by EAVE.

2. Installation.

The basic installation consists of: cabling, PVC piping to house the cabling, electrical protection according to regulations, small parts and fixings, labour, feedthrough, setup of Wallbox mobile app and processing and issue of the installation certificate (CIE).

Using the video or video call from step 2, EAVE will check the location of the installation to assess whether the basic installation is sufficient or extra parts are needed to fit it. In the latter case, EAVE will email the client within 24 working hours with a quote for the extra parts.

Once the client has sent their acceptance of the quote to EAVE, the latter will arrange an appointment with them to carry out the installation within a maximum of 5 working days. The client will pay the amount on the quote they accepted for the extra costs on the day of the installation via POST or online payment link. This payment is necessary to begin the installation.

3. Sending documentation to the client.

After carrying out the installation EAVE will email the invoice in pdf format, the installation report and the installation certificate (CIE) within a maximum of one week.

FIVE:- What is the price of the product?

The price depends on the power rating - 7.4 kW or 22 kW - and on the distance in metres - 20, 40 or 60 metres.

This is broken down below:

SIX.- What is the warranty and the after-sales service?

The applicable warranty and the after-sales service are governed by the contract for the package signed by the client and EAVE. In any case, the client is entitled to be offered a warranty on the products purchased and on their installation.

With regard to after-sales service, Wivai as an intermediary in the contract informs clients that, in the event of any incident, they may report it using the telephone number 911 291 018 from 9am to 6pm from Monday to Friday (working days at EAVE's business address).

SEVEN.- Is there a right of withdrawal?

Wivai only deals with the application for a contract, which is then, if appropriate, entered into between the client and EAVE. Any withdrawal must therefore be exercised before EAVE on the terms stipulated in the contract entered into with this firm. In any case, the term for withdrawal is 14 calendar days following signature of the contract, providing the package has not been installed.

If withdrawal is requested from EAVE or if the contract is terminated, if it was financed by CaixaBank, EAVE will inform Wivai of the said withdrawal so that Wivai can inform CaixaBank and the associated finance can automatically be cancelled.

The client may also withdraw from the preliminary application to Wivai for a contract within 14 days of this application being made.

- If the client exercises this right before the contract has been made with EAVE, the application will be cancelled and all sums charged so far will be refunded to the client. In the event that the financing linked to the contract has been contracted, it will be cancelled without any penalty and any repayments on the loan that might have fallen due and been paid by the client will be refunded.

- If the client exercises this right after the contract has been made with EAVE but before installation of the package contracted begins, they must apply to EAVE for withdrawal. The contract will be cancelled automatically. If financing has been contracted, this will be cancelled and any repayments on the loan that might have fallen due and been paid by the client will be returned.

Legal conditions of the marketing by WIVAI of the interior design project with furniture made by KAVE HOME

 

ONE.- What service is offered?

Through Wivai Selectplace, S.A.U (hereinafter “WIVAI”), both on its own website www.wivai.com, and in the WIVAI Store section of the Caixabank website, customers can request to contract the interior design project with furniture (hereinafter, the “Kave Home Room Set”) for the price that customers choose from those on offer, in order to then redeem it on the website of Kave Home, S.L.U. (hereinafter, “KAVE HOME” ).

The Kave Home Room Set consists of the purchase by customers of a voucher worth a certain sum for the purchase of furniture and decorations on the KAVE HOME Spain website (www.kavehome.com).

The Kave Home Room Set also includes the decoration service provided by a KAVE HOME interior designer, consisting of the creation of an interior design project for the room(s) chosen by customers, to help them, if they wish, with their choice of furniture. For the preparation of the interior design project by the designer, customers must (i) first complete a design questionnaire provided by KAVE HOME and (ii) register as a user on the KAVE HOME website, using the same email address as the one notified by WIVAI. The project will be presented to the customer by the designer via a video call, on a date when the customer has arranged an appointment with KAVE HOME.

The general conditions for the use of Kave Home gift cards will also be applicable, which are available at all times at www.kavehome.com .

TWO.- Services included

When ordering the Kave Home Room Set through WIVAI, the offered price includes the following additional services, which are valid for customers’ first order at KAVE HOME:

  • An interior design service by a professional
  • Transport
  • Assembly of the furniture inside the room (if customers so choose)

THREE.- Who will provide the service and who is it contracted with?

KAVE HOME with company tax number (C.I.F.) B55159271 and registered office at carrer Tallers (Pol. Industrial Can Cuca), 14, Sils (17410), Girona, will be responsible for providing the interior design service, and will also be responsible for the transport and assembly of the Kave Home Room Set purchased via WIVAI. It will also be the vendor of the furniture that may be bought with the Kave Home Room Set purchased through WIVAI.

After the ordering of the Kave Home Room Set through WIVAI, KAVE HOME will contact the customer by telephone to inform them about how the service works.

The steps will be as follows:

  • 1) The interior designer from KAVE HOME will call the customer to gather the necessary information about their style and preferences for the room they wish to change in order to design a suitable interior design.
  • 2) The choice of the date to schedule a video call between the designer and the customer, to show the customer the design project created in accordance with the chosen budget.
  • 3) After the meeting with the designer is completed, the customer will receive the list of suggested items by email and must accept or request amendments to the project. Once the project is accepted, the customer will receive, by email, all the details to make the purchase of the Kave Home Room Set. In order to complete the order in the KAVE HOME space, it will be necessary for the customer to use the user account created using the same email address that was used to complete the order on WIVAI.

The general conditions that are available at all times at www.kavehome.com will also be applicable to this transaction..

WIVAI will not have access to the design project contract that will be entered into between the customer and KAVE HOME.

FOUR.- Who markets the service?

Wivai Selectplace, S.A.U. with registered office at Gran Vía de les Corts Catalanes, 159, Barcelona (08014) and with company tax number (CIF) A-58481730 is the company that markets the Room Set with interior design service, selling the Kave Home Room Set for the sum that the customer wishes to spend, which will then be redeemed on the KAVE HOME website.

WIVAI will manage the sales of the Kave Home Room Set for the chosen sum for the later purchase of furniture at KAVE HOME through WIVAI marketing channels and will forward KAVE HOME information about said sales so that KAVE HOME can provide the service to customers.

FIVE.- What is the price for the service?

The total price of the service varies according to the price of the Kave Home Room Set chosen by the customer from the options offered by WIVAI.

Using the sum of the Kave Home Room Set voucher, customers can choose any of the products that KAVE HOME offers on its website (except for the exceptions included in the terms and conditions of www.kavehome.com), although they may only purchase the products that are available when they place their order. The Kave Home Room Set voucher will only be valid for purchases made on the Kave Home Spain website.

If the total price of the chosen products is higher than the price of the Kave Home Room Set voucher purchased on WIVAI, customers must pay the difference directly as if it were a separate and additional purchase to that made via WIVAI.

The price of the set is always shown in euros and includes VAT and any other taxes that are in force and legally applicable at the time.

If WIVAI identifies a clear mistake in the price of one of the published Kave Home Room Set products, it shall immediately notify the customer and make the relevant rectifying publication on the website and the usual media, and the customer will have the option to either reconfirm their order at the correct price or cancel it, through the “My Account” section.

WIVAI expressly reserves the right to change the prices at any time with no need for prior notice. However, in all instances, the prices in force on the Website when the order in question is placed will be applied to the Customer.

SIX.- What are the available payment methods?

To make payment, customers must follow all the instructions shown in the online contracting request process in the WIVAI online purchase flow process.

All the payment methods provided by WIVAI are subject to payment checks and authorisations by companies (card issuers and/or payment account providers), and if said company does not authorise the payment, then the initiated purchase procedure may not continue and the order will be automatically cancelled.

The charge of the product or service price and of any applicable taxes will occur when the contracting request is made.

Customers can use the following payment methods:

  • Immediate payment: by card, without financing.
  • Payment by finance: payment option available for products where financing is expressly offered through the following options:
    • Through a loan granted by CaixaBank, S.A.
    • Through payment in instalments made with a card from CaixaBank Payments & Consumer E.F.C., E.P., S.A.U. (hereinafter “CPC”) that accepts payment in instalments.

If a customer chooses the finance option and it is ultimately not granted, the contracting request for the Room Set and interior design will be automatically cancelled.

SEVEN.- What guarantee and after-sales service is there?

WIVAI is exclusively responsible for the guarantee and after-sales service regarding the purchase of the Kave Home Room Set voucher for the later purchase of items on the KAVE HOME website. That is, it will guarantee that the Kave Home Room Set voucher can effectively be used in order to buy items up to its price, on the KAVE HOME website.

And KAVE HOME, as the vendor of the items that the customer ultimately acquires by redeeming the balance of the Kave Home Room Set voucher bought through WIVAI, will be responsible for the guarantee and after-sales service of the purchased items and for the interior designer service that a KAVE HOME designer will provide.

Customers can report any incident using any of the following methods:

  • 1) To the WIVAI Customer Service Department
  • 2) To KAVE HOME, by calling 900 897 980

EIGHT.- Do customers have a right of withdrawal?

Yes, customers have a right of withdrawal for a period of 14 calendar days after the delivery and assembly of the items in the customer’s home.

Withdrawal from the specific furniture and/or decoration items chosen by customers on the KAVE HOME website is regulated by KAVE HOME in the general purchase conditions on its website.

In the event of total withdrawal from the order after delivery and assembly in the customer’s home, WIVAI will have the authority to decide if the costs associated with the project management are charged to the customer. Said costs will be equivalent to €40 for the interior design service plus 10% of the sum spent during the first purchase at KAVE HOME.

NINE.- Disclosure of your personal data

Consequently, both parties will be considered the "DATA CONTROLLERS”.

All the obligations relating to the processing carried out by KAVE HOME will be regulated in the KAVE HOME privacy policy.
